1. Overview and Acceptance of Terms

These Terms & Conditions (“Terms”) apply to your use of Bonza Lottery (“we”, “us”, “our”) – a weekly trade-promotion lottery run via WordPress and Stripe Checkout. By purchasing tickets, you agree to these Terms.

2. Eligibility

• Participation in Bonza Lottery draws is strictly limited to individuals aged 18 years or older who reside in Australia (excluding ACT unless Bonza holds a valid ACT trade promotion lottery permit). By entering a draw, you confirm that you meet these eligibility requirements.
• Residents of the Australian Capital Territory (ACT) are excluded due to permitting restrictions under trade promotion laws.
• Bonza reserves the right to request proof of age and residency before awarding any prize. Failure to provide satisfactory evidence may result in forfeiture of the prize and a redraw at Bonza’s discretion. Refunds are not available where an entrant falsely claims eligibility.

3. Lottery Nature & Prize Pool

This is a trade-promotion lottery (game of chance), not a gambling service. Winners are selected randomly, and the total weekly prize pool is capped at $5,000 AUD. All prizes are funded solely from ticket sales; Bonza retains 15% for operational costs.

4. Ticket Purchases

• Ticket options: $5, $10, $20, $50.
• Purchased via Stripe Checkout; payments are subject to Stripe’s terms.
• Tickets are non-refundable unless legally required (see section on Cancellation).

5. Draw Process

• Draws occur weekly; winners are chosen at random.
• Prizes are paid from the accumulated pool.
• Winners are publicly announced (first name and initial only).

6. Cancellation and Refunds

Once purchased, tickets are final and non-refundable, except where required by law (e.g. technical errors or cancellation by Bonza due to regulatory change). We reserve the right to cancel draws with sufficient notice and process refunds as needed.

7. Liability Limitation

To the maximum extent permitted by law, Bonza is not liable for indirect, incidental or consequential losses, including lost opportunity. If liability cannot be excluded under the ACL, it is limited to the price of the ticket purchased.

8. Compliance & Permitting

Operating in compliance with Australian Consumer Law and state/territory trade-promotion regulations, we highlight that:

• Prize pool capped at $5,000 avoids permit requirements in many jurisdictions including ACT.
• We exclude ACT to avoid permit risks and ensure lawful operation.

9. Privacy and Data Use

Your personal data is handled under our Privacy Policy, including rights to access, correct, delete data, and opt-out of communications.

10. Communication and Spam Act Compliance

By providing your email, you consent to receive transactional and promotional emails, which you may opt out of at any time in accordance with the Spam Act 2003.

11. Modifications

We may modify these Terms. Updates are effective from the “Last updated” date. Continued participation constitutes acceptance of changes.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia.
